Supreme Court Justice Qazi Faez Isa alleged on Thursday that former Supreme Court Chief Justice Asif Saeed Khosa had betrayed him and "stabbed" him in the back.


Judge Isa made the remarks during a hearing on the petitions for review filed against the ruling of the superior court on June 19, 2020, regarding the presidential reference against him. Judge Umar Ata Bandial presided over the court of 10 SC judges that conducted the hearing.


"The Supreme Council of the Judiciary (CSJ) has assassinated justice," said Magistrate Isa, adding that President Dr. Arif Alvi "did not bother" to respond to three of his letters and that he had not even received a copy. of the presented presidential reference. Against him.


He said that despite that, the noise and voices against him had started in the media and a "fifth generation war" was started against him and his family.

"Former Chief Justice Asif Saeed Khosa stabbed me in the back without listening to my position," Judge Isa commented. He also said that although retired judge Sheikh Azmat Saeed had been his friend, "I was saddened by his decision. Today he is the government's favorite personality."


Judge Muneeb Akhtar observed that the two judges were retired and asked Judge Isa to refrain from "making accusations" against them, while Judge Maqbool Baqar asked him to present his arguments in the case.


"Isn't Faez Isa a judge of this court? Are the names of [Judge] Azmat Saeed and [Judge] Asif Saeed Khosa too sacred?" Judge Isa asked in response.


The reference filed against Judge Isa by the government in May 2019 alleged that he had acquired three properties in London on lease in the name of his wife and his children between 2011 and 2015, but did not disclose them in the wealth declarations of he. Judge Isa had challenged the accusation, saying that he was not a beneficial owner of the apartments, directly or indirectly.


Judge Isa's wife, Sarina Isa, had said in a letter to the president in November that the reference against Judge Isa was shown to her husband by retired Judge Khosa before referring it to the SJC. "My husband told Judge Khosa that the properties were not his and that he was not concerned," the letter said.


According to the letter, Judge Khosa had observed, “how then can the reference be maintained?”, But then “something changed” and decided to summon the SJC, allegedly without trusting Judge Isa.


He said that Judge Khosa had repeatedly called then Attorney General (AG) Anwar Mansoor Khan, who, after the reference was submitted, allegedly asked the adviser to the Prime Minister of the Interior and Accountability Shahzad Akbar to provide him with the tax returns. by Sarina.


"The attorney general and the workers of a political party came together and Judge Khosa complied by asking for the trace of the money and the source of the funds for the purchase of the London properties," the letter said.


Likewise, Sarina had said in her letter, Judge Azmat Saeed had heard another reference against Judge Isa six business days before his retirement, trusting that it would be concluded before he retired.

The FBR has not sent me a notice '

Judge Isa said during today's hearing that the Federal Revenue Board (FBR) had not sent him a notice to date. He stressed that his children and his wife were not under his care, adding that they had not been under his patronage when they bought the properties in London and "like [Prime Minister] Imran Khan, my wife did not hide her properties" .


"The Niazi Services case was not referred to the FBR [but] in my case, the court acted with distinction."


Judge Isa further said that the total value of his properties in London was not even equivalent to "an F-6 plot", referring to a sector in Islamabad.


Judge Isa also criticized the Minister of Law, Farogh Naseem, saying that he had made accusations against him and his wife and that "respect for the court is not important to him (Naseem), but his ministry is. ".


"Farogh Naseem came to the rostrum and kept lying," added Judge Isa.


He said the SJC had taken action against him at a time when he had taken his summer vacation and was affected by personal matters.


"The decision to send the case to the FBR was outside the jurisdiction of the court. Article 184 (3) is for the protection of fundamental rights [and] the order of the notification of the FBR to my daughter and son does not enter in the category of fundamental rights ".


'They want to get me out'

"They want to remove me from the post of South Carolina judge," Judge Isa said, adding that the motive was his verdict in the 2017 Faizabad sit-in case.

He said that apart from the head of Tehreek-i-Labbaik Pakistan, Allama Khadim Hussain Rizvi, "everyone else" had filed petitions for review against the sentence, citing the PTI and the Muttahida Qaumi Movement, with the former stating "I am not eligible to be a judge. "


"I am not really qualified to be a judge because I am talking about fundamental rights.


"I will fight to the last drop of blood. I will not give up," Judge Isa said.


He also criticized Akbar, saying that the adviser had not denied any accusations against him. Judge Isa said Akbar "should be in jail but he is in an important office."


"I don't understand if we are living in a democracy or a dictatorship," he said.
